1. Acceptance of Terms

By accessing or using Mardi Mix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Mardi Mix. You must be at least 13 years of age (or 16 in the EEA) to use the Service.

2. Description of Service

Mardi Mix is an AI-powered content and entertainment platform offering tools including, but not limited to, AI-assisted blog and article creation, AI-generated imagery, interactive games, astrology features, news content, and other creative utilities. All games, astrology content, news articles, blog posts, and images available on the platform may be fully or partially generated using artificial intelligence.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.

3. AI-Generated Content Disclosure

Mardi Mix uses artificial intelligence systems — including models provided by Anthropic, OpenAI, and Google — to generate text, images, game content, astrological interpretations, and other media throughout the platform. You acknowledge and agree that:

• Content labeled with a user's name and avatar as "author" may have been generated in whole or in part using AI tools at that user's direction. Author attribution reflects the user who initiated and directed the content creation, not necessarily a human author who wrote every word.
• AI-generated content may contain inaccuracies, errors, or outdated information. Mardi Mix does not warrant the factual accuracy of any AI-generated content on the platform.
• Astrological readings, tarot interpretations, and similar content are provided for entertainment purposes only and do not constitute professional advice of any kind.
• News and editorial content on the platform may be AI-generated. It is the responsibility of each user to verify information independently before relying on it.

4. User Accounts

To access certain features you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. User-Generated and AI-Assisted Content

When you create, upload, or publish content through the Service — whether written by you or generated with AI assistance — you represent and warrant that:

• You have the right to submit and publish that content
• The content does not violate any applicable law or third-party rights
• The content is not defamatory, obscene, harassing, or harmful
• The content does not impersonate any person or misrepresent your affiliation

By publishing content on Mardi Mix, you grant us a non-exclusive, royalty-free, worldwide license to host, display, and distribute that content as part of operating the Service.

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, to be inappropriate, harmful, or contrary to the interests of the platform or its users.

6. Copyright and AI-Generated Content Ownership

Content generated solely by artificial intelligence, without meaningful human creative authorship, may not be eligible for copyright protection under applicable law, including guidance from the U.S. Copyright Office. Mardi Mix makes no representation that AI-generated content produced through the Service is copyrightable or that users hold exclusive rights to such content.

You are responsible for determining the intellectual property status of any content you publish or distribute, including content generated with AI assistance. Mardi Mix is not liable for any intellectual property claims arising from content you create or publish on the platform.

The platform itself — including its design, branding, underlying code, and original non-AI content created by Mardi Mix — is protected by copyright, trademark, and other intellectual property laws and remains the exclusive property of Mardi Mix.

7. Mardi Mix Pro Subscription

Mardi Mix offers a paid Pro subscription tier that grants the following additional benefits:

• The ability to upload and publish user-created blog content
• An ad-free experience across the Service
• Access to additional features as made available from time to time

Subscriptions are billed on the cycle displayed at the time of purchase. Payments are processed by a third-party payment provider. All sales are final unless otherwise required by applicable consumer protection law. We reserve the right to modify Pro pricing or features with reasonable advance notice to subscribers.

8. Advertising

Free-tier users of the Service may be shown advertisements served by third-party advertising networks. These ads are clearly distinguishable from editorial or user-generated content. Mardi Mix is not responsible for the content of third-party advertisements. Pro subscribers are not shown advertisements.

9. Prohibited Conduct

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law
• Generate, upload, or distribute content that is defamatory, obscene, harassing, hateful, or that promotes violence or illegal activity
• Impersonate any person or entity, or falsely represent your affiliation
• Publish AI-generated content presented as verified factual news without appropriate disclosure
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Use automated means to scrape, crawl, or extract data from the Service without written permission
• Interfere with or disrupt the integrity or performance of the Service
• Use the AI tools to generate spam, malware, phishing content, or misleading information at scale

10. Accuracy of Content and Entertainment Disclaimer

All content on Mardi Mix — including AI-generated articles, blog posts, news content, astrological readings, tarot interpretations, game outcomes, and images — is provided for entertainment and informational purposes only. Mardi Mix does not guarantee the accuracy, completeness, or timeliness of any content on the platform. Nothing on the Service constitutes professional medical, legal, financial, psychological, or other licensed professional advice. Users should not rely on platform content as a substitute for professional guidance.

11. Third-Party Services and Links

The Service integrates third-party AI providers and may contain links to external websites. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of third-party services is governed by their respective terms and policies.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy of AI-generated content, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Mardi Mix and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of revenue, reputational harm, or any damages arising from reliance on AI-generated content — resulting from your use of or inability to use the Service. Our total liability for any claim arising from these Terms shall not exceed the greater of $100 USD or the amount you paid to us in the three months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Mardi Mix and its affiliates from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights related to content you create or publish on the platform.

15. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction in Louisiana, and you consent to personal jurisdiction in that forum.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, by notifying registered users via email or an in-app notice. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
